These Terms of Service (“Terms”) govern your use of truckingservicesolution.com and the services we provide (“the Site”), operated by Trucking Service Solution (“we”, “our”, “us”). By creating an account, submitting a listing, or otherwise using the Site, you agree to these Terms. If you do not agree, do not use the Site.
Description of Service
The Site is an online directory that connects truckers and fleet operators with service providers — repair shops, towing companies, truck stops, parts suppliers, and similar businesses. We provide search tools, listing pages, reviews, and related features. We do not employ the businesses listed on the Site and we are not a party to any service or transaction between users and listed businesses.
Eligibility
You must be at least 18 years old and able to form a binding contract under applicable law to use the Site. By using the Site you represent that you meet these requirements.
Accounts and Listings
- You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
- You agree to provide accurate, current, and complete information when registering, claiming a listing, or submitting content.
- Each business may maintain one primary listing. Duplicate or misleading listings may be removed at our discretion.
- We may suspend or terminate any account that violates these Terms, applicable law, or our published policies.
User Content
“User Content” includes listings, descriptions, photos, reviews, ratings, comments, and any other material you submit to the Site.
- You retain ownership of your User Content. By submitting it you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, display, reproduce, modify, distribute, and otherwise use that content for the operation and promotion of the Site.
- You represent that you have all rights necessary to grant this license and that your User Content does not infringe any third party’s rights.
- Reviews must reflect your honest experience. You may not post reviews of your own business, your competitors, or in exchange for compensation.
- We may remove, edit, or refuse any User Content for any lawful reason, including violations of these Terms.
Acceptable Use
You agree not to:
- Use the Site to violate any applicable law or regulation.
- Post content that is false, fraudulent, defamatory, harassing, threatening, hateful, obscene, or otherwise objectionable.
- Impersonate any person or business or misrepresent your affiliation with any person or entity.
- Submit content that infringes any patent, trademark, trade secret, copyright, privacy right, or other intellectual property right.
- Use any automated means (bots, scrapers, crawlers) to access, harvest, or copy data from the Site without our written permission.
- Interfere with or attempt to disrupt the Site’s security, integrity, or performance — including probing for vulnerabilities, brute-forcing logins, or launching denial-of-service attacks.
- Use the Site to send unsolicited commercial messages, spam, or chain communications.
Paid Plans, Billing, and Refunds
- Certain features — such as featured placement and enhanced listings — are available on paid subscription plans. Plan pricing, features, and billing intervals are described on the pricing page at the time of purchase.
- Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date. You can cancel at any time from your account dashboard.
- All fees are charged in advance and are non-refundable except where required by law. We may, at our discretion, offer pro-rated refunds for service interruptions caused by us.
- Payments are processed by Stripe or PayPal under their respective terms. We do not store full payment card numbers on our servers.
- Applicable taxes (including VAT where required) are added at checkout.
Intellectual Property
The Site, its design, code, logos, and all materials provided by us are owned by Trucking Service Solution or our licensors and are protected by intellectual-property laws. You may not copy, modify, distribute, or create derivative works from any part of the Site without our prior written permission, except for normal use of the Site as intended.
Third-Party Services and Links
The Site may contain links to third-party websites and integrations with third-party services (such as Stripe, PayPal, Google Maps, and reCAPTCHA). We do not control those services and we are not responsible for their content, policies, or practices. Use of any third-party service is subject to that service’s own terms.
No Endorsement of Listed Businesses
Listings appear on the Site at the request of the listed business or because we have included them in our directory. Inclusion does not constitute an endorsement, recommendation, or verification of any business’s quality, qualifications, licensure, insurance, or pricing. You are responsible for evaluating any service provider before engaging them.
Disclaimers
The Site is provided “as is” and “as available,” without warranties of any kind, express or implied. To the maximum extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted operation. We do not warrant that any listing, review, or other content on the Site is accurate, complete, or current.
Limitation of Liability
To the maximum extent permitted by law, Trucking Service Solution and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, including loss of profits, revenue, data, or business opportunities — even if we have been advised of the possibility of such damages. Our total aggregate liability for any claim arising out of these Terms will not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) USD 100.
Indemnification
You agree to indemnify and hold harmless Trucking Service Solution and its affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your User Content, your use of the Site, or your violation of these Terms or applicable law.
Termination
We may suspend or terminate your access to the Site at any time, with or without notice, for any reason — including violation of these Terms. You may close your account at any time from your dashboard. Sections of these Terms that by their nature should survive termination (including User Content license, disclaimers, limitations of liability, indemnification, and governing law) will continue to apply after your account is closed.
Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Illinois, United States, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Site will be resolved exclusively in the state or federal courts located in Cook County, Illinois, and you consent to the personal jurisdiction of those courts.
Changes to These Terms
We may update these Terms from time to time. Material changes will be announced on the Site or by email. The “Last updated” date at the top of this page reflects the most recent revision. Your continued use of the Site after a change takes effect constitutes acceptance of the updated Terms.
